Terms of Service

1. Introduction and Acceptance of Terms

Welcome to Kagenten (the "Service"), a conversational AI platform that generates images from natural-language descriptions — including AI travel journals, style makeovers, and posters. These Terms of Service ("Terms") form a binding agreement between you and Kagenten ("we", "us", "our"). By accessing or using the Service — including by creating an account, submitting a prompt, or generating an image — you accept these Terms. If you do not agree, do not use the Service.

The Service is an AI image generation tool. It does not produce diagrams, charts, or code.

2. Description of the Service

Kagenten lets you create images by conversing with an AI agent:

  • You submit text prompts (and optionally reference images you own or have rights to);
  • The Service generates images based on your prompt, a selected style template, and the model you choose;
  • Generated images are displayed in your chat history and saved to your personal creations library;
  • You can download your generated images from the Service.

The Service may use third-party AI models (e.g., text-to-image models operated by third-party providers) to perform generation. Your prompts are transmitted to and processed by such providers solely to fulfill your request.

3. Eligibility and Accounts

  1. Eligibility: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use the Service. You must be at least 18 years old, or have the permission and supervision of a parent or guardian, to purchase credits.
  2. Account: You may use limited features without an account (guest trial credits). Creating an account gives you access to your chat history, creations library, and purchases.
  3. Security: You are responsible for your credentials and all activity under your account. Notify us immediately of any unauthorized use.
  4. Accurate information: Provide accurate registration information and keep it current.

4. Credits and Payments

  1. Credits: Image generation consumes credits. Your available balance is displayed in the Service. Certain credits are granted for free (guest trial, sign-in bonuses, daily free credits) and may carry expiration periods as disclosed in the product interface.
  2. Purchases: Paid credit packs and subscriptions are processed by our payment service provider. Prices are shown before checkout and include applicable taxes where required by law.
  3. Refunds: If a generation fails or is blocked by content moderation, the credits charged for that generation are automatically refunded to your account. Purchased credits are otherwise non-refundable, except where required by applicable law.
  4. No cash value: Credits are a prepaid usage allowance, have no cash value, and are not transferable.

5. Acceptable Use & AIGC Content Standards

You must use the Service lawfully and respectfully. The following categories of generated content are strictly prohibited:

  1. Sexual / NSFW content — including sexual imagery involving any depicted person, and any sexualized content generally;
  2. Violence & gore — graphic violence, gore, cruelty, or content that glorifies violence against people or animals;
  3. Hate speech & harassment — content that attacks, demeans, or incites hatred or discrimination against individuals or groups based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics; targeted harassment or bullying;
  4. Child safety violations (CSAM & minors) — any sexualization of minors, child sexual abuse material, or content endangering children. We have zero tolerance; attempts are reported to the relevant authorities and permanently banned. Content sexualizing real, fictional, or AI-generated persons who appear to be minors is equally prohibited;
  5. Deepfakes & impersonation — photorealistic imagery of real, identifiable people without their consent (including nude/sexual deepfakes), political disinformation imagery, and impersonation of brands, officials, or organizations in a deceptive manner;
  6. Copyright & trademark infringement — reproducing copyrighted characters, artworks, logos, or trademarks in ways that infringe third-party rights, and prompts you have no right to use (including uploading reference images you do not own or have a license to).

Also prohibited: attempting to generate the above categories via alternate spellings, obfuscation, or prompt injection; using the output of the Service to train competing models without written consent; automating access in violation of rate limits; and any use that violates applicable law.

5.1 Content Moderation

We operate automated content moderation on both inputs (prompts and uploaded reference images) and outputs (generated images). Prompts or uploads that violate these Terms may be blocked before generation; generated images that violate these Terms are blocked, are not delivered, and any credits charged for the blocked generation are automatically refunded. Repeat or severe violations (especially child-safety violations) result in account suspension or termination and, where legally required, reports to authorities and relevant organizations. Moderation decisions may use automated systems and can produce errors; if you believe your content was wrongly blocked, contact us (see §11) and we will review it.

5.2 Reporting Violations

If you believe any content generated through the Service violates these Terms — including child-safety concerns — report it immediately via the in-app feedback entry (bottom-right "Feedback" button) or by email to [email protected]. Reports should include the conversation or image reference and a short description. We review reports promptly and take enforcement action where warranted.

6. User Content and Intellectual Property

  1. Your prompts and uploads remain yours. You retain the rights to the text prompts and reference images you submit.
  2. Generated images: To the maximum extent permitted by applicable law, you own the images you generate and may use them for personal or commercial purposes. You acknowledge that (a) AI-generated imagery may not be protectable by copyright in some jurisdictions, (b) similar prompts may produce similar images for other users, and (c) you are responsible for your downstream use of generated images, including compliance with third-party rights and applicable disclosure obligations for AI-generated content.
  3. License to us: You grant us a limited license to process your prompts, uploads, and generated images solely to operate the Service (generation, storage, display to you, content moderation, and security), as described in the Privacy Policy.
  4. Platform: The Kagenten platform — code, design, brand, style templates, and prompt architectures — is our property and may not be copied or resold.

7. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service (including individual AI models and style templates) at any time. Generation is performed by third-party models and may be slow, unavailable, or produce unexpected results. We do not guarantee uninterrupted access.

8. Suspension and Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy, "Your Rights" for account deletion). We may suspend or terminate accounts that violate these Terms — including any prohibited content category in §5 — or that create risk or legal exposure for us, other users, or providers. On termination for violation, remaining paid credits may be forfeited to the extent permitted by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AI-generated images may contain errors, artifacts, misspelled text, or unintended content and must be reviewed before any use. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, Kagenten and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or relating to your use of the Service. Our total aggregate liability for all claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or USD 100 if you have not made any purchases).

12. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" above shows the current version. Material changes will be highlighted in the Service. Your continued use after changes are posted constitutes acceptance.
