Privacy Policy

This Privacy Policy explains how Kagenten ("we", "us", "our") collects, uses, stores, and protects your personal data when you use kagenten.com and our conversational AI image generation service (the "Service"). It also explains the rights you have over your data and how to exercise them.

1. Who We Are

Kagenten is a conversational AI image agent — you describe what you want (e.g., an AI travel journal), choose a style, and the Service generates images. For all privacy matters you can reach us at [email protected].

2. What Data We Collect

We do not collect special-category data, and we do not ask for data about you beyond what is needed to run the Service.

3. How We Use Your Data

• To provide the Service: process your prompts and uploads, generate images, store and display your history;
• To operate billing: track credits, process purchases through our payment provider, apply refunds automatically when generation fails or content is blocked;
• To keep the Service safe: content moderation of prompts, uploads, and generated images; rate limiting; fraud and abuse prevention;
• To communicate with you: service notices and support responses;
• To improve the Service: aggregate analytics on usage and generation quality.

We do not sell your personal data, and we do not use your content to advertise to others.

4. AI Processing and Third-Party Providers

To generate images we must send your prompt (and, when you use image-to-image editing, your uploaded reference image) to third-party AI model providers. These providers process the data solely to fulfill your generation request. We also use:

• A payment service provider to process credit purchases;
• Content moderation providers to check prompts, uploads, and generated images against our Acceptable Use standards (see the Terms of Service, §5);
• Hosting and database infrastructure to store account data, conversations, and images.

Content moderation may result in blocked prompts or generated images. Blocked generations are recorded for abuse prevention (with credits refunded).

5. Storage, Transfers, and Retention

• Account data, conversations, and transaction records are stored on managed cloud database infrastructure (currently in the United States);
• Generated images and uploads are stored in encrypted object storage; images you delete are removed from display and queued for deletion from storage;
• We keep personal data only as long as needed for the purposes above: account data for the life of your account; transaction records as required by tax and accounting law; moderation logs as needed for safety and legal compliance;
• Where data is transferred internationally, we rely on appropriate safeguards required by applicable law.

6. Your Rights

Depending on your jurisdiction (including GDPR for EEA/UK users and similar laws elsewhere), you have the following rights over your personal data:

1. Access (查询) — request a copy of the personal data we hold about you;
2. Rectification (更正) — request correction of inaccurate data;
3. Erasure / Deletion (删除) — request deletion of your personal data;
4. Account deletion (注销账号) — delete your account yourself, at any time;
5. Restriction & objection — object to or ask us to restrict certain processing;
6. Data portability — receive your data in a structured, commonly used format;
7. Withdraw consent — where processing is based on consent, withdraw it at any time;
8. Complain — lodge a complaint with your local data protection authority.

How to exercise your rights:

• Delete your account yourself: sign in → Account → Delete Account. This immediately deactivates the account, removes your personal data (nickname, email, login identifiers), deletes your uploaded reference images and generated images from storage, and anonymizes your historical records. This cannot be undone.
• Everything else: email [email protected] (or use the in-app Feedback button, bottom-right). We respond within 30 days.

Guest (anonymous) users: clear your browser's local storage to remove the anonymous identifier, or request deletion of guest data by email.

7. Security

We protect your data with encryption in transit, hashed passwords, strict database access controls (all user-content access flows through our authorized backend), and rate limiting. No internet transmission or storage system is 100% secure; if a breach affecting your data occurs, we will notify you as required by law.

8. Children's Privacy

The Service is not directed to children under 13 (or the higher minimum age of digital consent in your jurisdiction). We prohibit child-safety-violating content under our Terms of Service and enforce it through content moderation. If you believe a child has provided us personal data, contact us and we will delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. The "Effective Date" at the top shows the current version. Material changes will be highlighted in the Service. Continued use after changes are posted constitutes acceptance.
